Attacks on your property rights

As a property owner, beware the communities that want to infringe on your property rights

property rightsI am a big fan of property rights. It should be ridiculously hard for any government to take your property and infringe on your use of that land in any way. Don’t for a minute think that this sort of thing is limited to eminent domain – as we will see, there are communities where governments will try to control your land without even going to the trouble of exercising eminent domain.

On todays show we are going to look at a couple of amazing stories of property owners and investors who are being forced to fight for their property rights in the face of governments that want to decide for them what can and cannot be done with their land. For you investors, knowing the communities where the cities are most likely to control or dictate your investment could save you a whole lot of heartache!

More Subprime Style Shenanigans

federal reserve interest rateOur big topic for today spans a few stories. Subprime lending style strategies are back and they are scary. While there are protections now that were missing before, these are the kinds of things that evolve as institutions get comfortable with them. In short, setting a bad precedent. From bank firings to HELOC defaults, we are seeing lots of instability in the lending world and lots of efforts to get more money into the hands of folks who are risky at best. All it would take is some collapse in any of the current markets and we could see yet another downturn in real estate. The worst part is that there are more points of weakness today than last time and our economy is in much worse shape than last time, so things get much worse much faster.

Then we will take a few minutes to talk about eminent domain and a plan right here in the bay area to seize private property because the county does not like what the property owners want to do with their property.

Real estate the Trump way!

Should you elect Trump for his real estate prowess?

So after my show on Donald Trump and his apparent love of eminent domain, I got quite a few folks reaching out to me to set me straight on the man. According to folks I have talked to, we should elect Mr. Trump because he is a self made man. He took his real estate efforts to new heights through his superior business skills. He is also an amazing negotiator.

So after a good number of discussions with folks – who nearly all expressed the above – I thought it would be a good idea to explore this a bit more and shed a little light on the real estate end of Donald Trump. In this case, we will use the exact same criteria we have used on this show before to figure out whether or not we are doing well at investing in real estate. After all, if you can make more money putting your cash into a fund and not have to do anything other than breath… you should!

So lets apply the same rules I suggest you apply to yourself and I apply in my own business and see what the data tells us!

Donald Trump and Eminent Domain

For my long time listeners, you know how I feel about eminent domain. In todays show, we will get a bit of a refresher course on what eminent domain is. What it is used for and how it is abused. Everyone from buyers, sellers, investors and entrepreneurs should care about eminent domain. It is easy to try and take comfort in the idea that the odds are that it won’t happen to you, but an injustice allowed to one of us is an injustice committed against all of us.

What makes this topic even more relevant today is that there is one presidential candidate that has made his feelings on eminent domain very clear. So we will also explore Donald Trumps involvement with eminent domain. How he has praised its use and made use of it to remake the world more to his hearts desire.

The Bigger Picture on Real Estate

There are lots of reasons I like real estate. Anyone who has met me when showing a home can tell you that I really do enjoy the process of viewing homes and imagining what they could be and what they have been.

I love trying to figure out what the architect or builder was going for. What were they thinking? Some of the best fun is in looking at much older homes and seeing how it evolved and was changed over the years. You can track how society values change with what was popular when different homes were built. For instance, the change in trend from having the kitchen be a place that is hidden away to a focal point of the family and having over guests. Sort of a rebirth of the hearth. I love that stuff.

But there is another level of real estate that I am particularly passionate about. Personal property rights are a cornerstone of democracy and a free society. Being able to buy land and tell the government to go screw themselves when they want to do something on it is practically built into the constitution. Our private property rights were born from American colonists being forced to open their doors to the British. If soldiers needed a place to sleep or food to eat, you had no rights other than simply opening your door and letting them have whatever they wanted.

So, the idea of private property rights were enshrined in our Bill Of Rights. The third amendment states.

No Soldier shall, in time of peace be quartered in any house, without the consent of the Owner, nor in time of war, but in a manner to be prescribed by law.”.

The principles were so important, that even the fourth amendment makes further mention of private property rights,

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures , shall not be violated, and no Warrants shall issue , but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

That is a big deal. It should remind all of us just how important it was to the founding fathers to preserve our freedoms when it came to our property.

A whole lot has happened since the days those words were written. The government, as most governments do, work constantly to enlarge their reach and power over us – at the expense of the rights set down when our country was born.

Whenever I get the chance, I try to expose these efforts. The use of “Eminent Domain” is the most well known example. We live in a time when the idea of eminent domain is used by government, even if the only public good is that the city can get more taxes by taking away your property and giving it to someone else who will do something else with it! The point I am trying to make tho is just what draws me to this business. Some of these bigger issues are exactly what makes the area of real estate so attractive to me. I suspect that most people do not consider this sort of thing when they are looking for their first home. But perhaps more of us should realize that we are exercising a critical right when we purchase property.
